Marijuana and The Wall Street Journal

The mighty Wall Street Journal (my favorite newspaper) has been hopping with pot talk lately. What's the Voice of Capitalism coming to? It started with an editorial page commentary on March 16 by constitutional expert Randy E. Barnett called "Reefer Madness". It was a learned assessment by Professor Barnett on how the federal courts go through constitutional contortions in maintaining the prohibition on medical uses of marijuana. The commentary was keyed by the Angel Raich story. On March 23 there were four letters in response. If you are a Journal reader, you know that's a lot for any one commentary, meaning there were probably hundreds that didn't get printed. There were letters from organizations "Common Sense for Drug Policy" and "Marijuana Policy Project" decrying criminalization of a useful drug. With all due (?) respect, sir, are you aware that opioid overdose deaths are way down in the states with legal marijuana? What's to Become of Us?  An America of Cheech & Chong? Or  of Steve Jobs, Willie Nelson, Bill Gates and Carl Sagan?* -18 states have legalized recreational weed. -38 states have legalized medical cannabis.  -17 "overlap" - both recreational and medical So this is one big sociological experiment. Precendents? Perhaps when Prohibition ended, and drinking went from bootleggers back to bars and package stores, it was sort of like this. Perhaps many folks who really wanted to drink a bit were encouraged to have a few pops after years of abstinence. Perhaps that's happening now with weed.  What Prohibition lacks as an analogue is that booze didn't sneak up from 90 proof to 120 proof, unless you moved right up to Everclear, and everyone knew what that would do.  With Cannabis, the "proof" is rising, and everyone is unclear on what that will do.  There are some worrying indications: Recently, there have been concerns surrounding the increased levels of THC f
